My vote is No. Happy to listen to the opinions of others if the collective
wants to have a meeting, though.
I don't believe there is risk of extrinsic evidence impugning the integrity
of a deed in the vast majority of our examinations and insured instruments.
This matters is extreme in the deceased's actions in signing 6 different
deeds as she worked through how to set up her estate planning.

Bryan Perez has asked if WLTA will write an amicus brief supporting his
position in an appeal to the Supreme Court. The appellate court opinion,

I hope everyone has been doing well and enjoying their summer.
Bryan Perez has asked if WLTA will write an amicus brief supporting his
position in an appeal to the Supreme Court. The appellate court opinion,
along with briefs are attached. Specifically, he feels that our industry
should be concerned that the courts are reviewing extrinsic evidence when
considering the validity of a deed and not solely relying on a facially
unambiguous, recorded deed in compliance with statute.
My recommendation is that we decline this request. This situation involves a
very specific set of circumstances, and I do not think the decisions made by
the superior or appellant courts amount to a shift in how conveyances are
viewed. For our purposes, insurers can and do take into account extrinsic
evidence to determine insurability.
That being said, I'm happy to set up a meeting if anyone would like to
discuss further. Please let me know.
