Specifically, he feels that our industry should be concerned that the courts are reviewing extrinsic evidence when considering the validity of a deed and not solely relying on a facially unambiguous, recorded deed in compliance with statute. <o:p></o:p></span></p><p class=MsoNormal><span style='font-size:11.0pt'><o:p> </o:p></span></p><p class=MsoNormal><span style='font-size:11.0pt'>My recommendation is that we decline this request. This situation involves a very specific set of circumstances, and I do not think the decisions made by the superior or appellant courts amount to a shift in how conveyances are viewed.
