Hello Board Members,

 

Re the OIC Claims Handling Rules.  Below is Lindsy’s email and my second letter to the OIC re the proposed changes.  It must be submitted by Monday, October 6.  Let me know if you object to the WLTA sending the attached letter or have any changes.

 

Also – does anyone have a comment on whether we could get a carve-out for title insurers as asked by Lindsy in her email below?  My sense is that it doesn’t hurt to ask but I doubt it would fly.

The OIC has produced its second pre-publication draft . https://www.insurance.wa.gov/laws-rules/legislation-and-rulemaking/rulemaking/clarifying-and-updating-minimum-standards-claims-handling-r-2025-05

 

Comments are due 10/06/2025. 

 

Our Managing Claims Counsel that reviewed the second draft provided the following comments:

 

“The second draft of 284-30-340 now allows an insurer to withhold third-party financial information but requires production of a log indicating what the withheld information is and the reason. The second draft does not say who receives the log (the OIC or the insured), what “legally privileged” means outside of litigation discovery, or how disputes as to the application of a privilege would be resolved. Also, the second draft doesn’t address our concerns for added litigation risk and administrative burden.”

 

He also asked if we thought the OIC would be willing to carve out title insurers from this requirement completely. I’d like to get WLTA’s thoughts on this and perhaps Carrie’s thoughts on whether that’s a reasonable request.
