I would think all title insurers and title agents. There may also be escrow only agencies that handle long term escrow contracts but will let others in WA speak to that since my knowledge base is grounded in Idaho law

No our clients are primarily private party Buyers and Sellers in which the Seller engages in seller carry-back financing for the Buyer and we simply service the payments owing on the contract.

Hi All - I have been working on this bill for the bankers association. The bill is going to be narrowed. Here’s the definition the sponsor is considering. He plans for the hearing to be on the proposed substitute language. The hearing is likely to be next week.
It will limit the policy to non-depository mortgage loan servicers as defined below. Note, that “financial institutions” are excluded, and a “financial institution” as defined in RCW 30A.22.040 is: (8) "Financial institution" means a bank, trust company, mutual savings bank, savings and loan association, or credit union authorized to do business and accept deposits in this state under state or federal law.
(1) “Non depository mortgage loan servicer" means an entity, wherever located, that is responsible for servicing a residential mortgage loan, including collecting or receiving payments on existing obligations due, including payments of principal, interest, escrow amounts, servicing fees, and other amounts due. A mortgage loan servicer does not include:
(a) A financial institution as defined in RCW 30A.22.040;
(b) A federal agency or department; or
(c) A collection agency as defined in RCW 19.16.100.

Three member companies who provide contract loan servicing have weighed in on this and the consensus is that if the bill were to pass in the current form these companies would likely stop offering escrow for tax and insurance reserves meaning consumers will have even fewer options available to them in the market. This is a low margin business and the funds held in escrow are not held in interest bearing accounts so the costs to set that up for each client and pay them 2% interest (business accounts do not earn anywhere near that level of interest) will be passed on to the client via rate increases that would likely cause the clients to decline the service. If we can propose language that would carve out Collection Escrow providers from the bill I think we should.

Long Term services are not “profit centers” for us, but a necessary option for seller carry back and private financing loans. The costs of handling reserve accounts would have to increase substantially, and I believe deter individuals from setting them up. That is not the best resolution for many consumers, as that monthly reserve deposit is what helps to ensure to the seller that there are funds to pay taxes and insurances when due.

Below are the thoughts of Pioneer Title Company of Washington (and its long-term escrow department) as it relates to the proposed legislation:
In talking to the manager of our long-term escrow department (which does service files out of Washington State), she does not like this proposed legislation at all. Currently, the monies escrowed for taxes and insurance are in a non-interest bearing trust account. If this became law, we would have to convert to an interest bearing trust account in order to pay the borrower the required 2% … and we would have to adjust our software and accounting functions to adapt to the legislation. That would result in an increase in fees to set up Washington State files and an increase in monthly servicing fees to handle each account under the new legislation. The net monetary result to the borrower would likely not be positive.

Bob,
In talking to the manager of our long-term escrow department (which does service about 100 files out of Washington State), she does not like this at all. Currently, the monies escrowed for taxes and insurance are in an non-interest bearing trust account. If this became law, we would have to convert to an interest bearing trust account in order to pay the borrower the required 2% … and we would have to adjust our software and accounting functions to adapt to the legislation. That would result in an increase in fees to set up Washington State files and an increase in monthly fees to service the account under the new legislation. The net result to the borrower would likely not be positive.

Sean has reviewed HB 2268 and is requesting additional eyes on it. His review is below and he is specifically asking for members of the committee who are familiar with collection escrow accounts to weigh in.
HB 2268 - “Residential Mortgage Escrow Acounts, …”
WLTA position depends on how many members are currently conducting collection escrows on residential real properties (1-4 residences) with associated tax and insurance escrow accounts. Bill defines a “mortgage loan servicer” as any entity that has an agreement with the lender or investor of a residential mortgage loan to collect payments, including principal, interest, escrow, etc. Starting January 1, 2027, for residential mortgages executed on or after that date, servicers will have to pay borrowers interest on funds held in tax or insurance escrows of at least 2% annual simple interest. No fee or charge may be imposed that would reduce the interest rate to less than 2%. In a low interest rate environment that floor could mean that borrowers would have to be paid more than the servicer could earn on the funds.
My only experience with collection escrows is on the claims side and many years ago. I don’t know enough about collection escrows to provide a recommendation on the WLTA position. I’m asking other members of the committee who are more familiar with collection escrows and current practices to weigh in.

Neutral. Affects local government permitting only. No direct effect on title industry, land title records system, or real property law.
Various forms of transitional or emergency housing will have to be allowed in all zones other than industrial. Applies to cities and counties subject to Chapter 36.70A RCW (Growth Management Act) and cities subject to Chapters 35.21 and 35.21A RCW. The permitting standards applied to the specified housing types must match those applied to residential housing in general. Does not override private CC&Rs which may limit such housing or impose more onerous requirements than a typical residence might face.
