Subject: SB 5796 (Common Interest Communities)

 

I have reviewed all 193 pages (yawn.) and do not find anything to warrant
opposition by WLTA. Its main intent is to update many cross-related
provisions of various RCWs to be consistent with WUCIOA. My recommendation
is "neutral".

 

This amends existing WUCIOA (RCW 64.90) with respect to CICs (plats, condos,
cooperatives & "miscellaneous communities") but also many related chapters,
particularly those involving HOAs, but also the foreclosure & subdivision
statutes.  Too many sections to list here.

 

However, I have some questions for the drafter that involve what appear to
me to be inconsistencies or ambiguities, and will discuss with Joe McCarthy
at Stoel Rives. (I assume he is the principal drafter of this bill, having
chaired the Bar committee that drafted it.)

 

I did not look for a companion House bill for comparison,
