different than those of other types of insurance (P&C or health) due to the fact that we are communicating with and collecting NPI from many additional parties beyond our insured as stated in the letter.<o:p></o:p></span></p>

The second draft does not say who receives the log (the OIC or the insured), what “legally privileged” means outside of litigation discovery, or how disputes as to the application of a privilege would be resolved. Also, the second draft doesn’t address our
concerns for added litigation risk and administrative burden.”</span><o:p></o:p></p>
