As an agent, when we receive claims directed our way, we will forward on to the claims counsel of the underwriter. If I am on vacation and I take a week to forward a claim, then it seems like the underwriter may have 8 days to respond, through no fault of your own. Maybe I'm misinterpreting it?

Additionally, I'm not sure their proposed rules take into account that as an agent, if I do receive a claim, it's not my job to respond, but it seems I am now bound by some timeline or new responsibility?

Their definition of insurer looks like it would include an agent like us: " (10)(11) "Insurer" means any individual, corporation, association, partnership, reciprocal exchange, interinsurer, fraternal mutual insurer, fraternal mutual life insurer, and any other legal entity engaged in the business of insurance, authorized or licensed to issue or who issues any insurance policy or insurance contract in this state. "Insurer" does not include health care service contractors, as defined in RCW 48.44.010, and health maintenance organizations, as defined in RCW 48.46.020."
